Historical Background:
The passage by the New York State Legislature of an act dated 12 April 1813, provided relief to debtors in the case of insolvency. Insolvency proceedings consisted of both voluntary (the petition by the debtor and creditors to the court) and involuntary (the petition by creditors given an absent debtor) with the both the county and supreme courts having jurisdiction in such matters prior to 1830.
During the period 1830-1847, voluntary matters were brought before the county court, while involuntary proceedings were processed at the Supreme Court level. The reorganization of the court system in 1847 awarded exclusive jurisdiction in matters of insolvency to the Supreme Court.

Consists of handwritten, legal documents of varying sizes, refiled into acid-free enclosures (by year, surname), and including the petition of the debtor and creditor requesting the sale, affidavits as to the amount of indebtedness, names of creditors and amounts owed to each, inventory, notice of sale, certification of publication, certificates of assignment, and final discharge from liability. Case files for each are voluminous and of fragile condition.
